Summary: Debarment was proposed because an Office of Inspector General investigation was conducted to determine whether employees of Farmers Cooperative Society (FCS), a Sioux Center, Iowa, based grain elevator, blended oats with soybeans and sold the mixture as soybeans. By blending lower valued oats, FCS was able to increase the weight and volume of the commodities and market them as higher valued soybeans. The investigation disclosed that from approximately 2010 and continuing through April 2017, employees of FCS’ facilities in Sioux Center, Sanborn, and Boyden, Iowa, and the FCS facilities in Alcester and Worthing, South Dakota, mixed oats with soybeans and/or stored the mixture in bins at their facility. DIEHL signed a plea agreement pleading to one count of 18 U.S.C. 371 Conspiracy to Defraud the United States. EHRP was charged with one count of 18 U.S.C. 371 Conspiracy to Defraud the United States, one count of 7 U.S.C. 87 & 18 U.S.C. 2, Prohibited Grain Practices and two counts of 18 U.S.C. 1014, False Statements. On February 2, 2021, DIEHL was sentenced to three months in prison, one year of supervised release, and a $7,600 fine which included a $100 special assessment. On March 24, 2021, EHRP was sentenced to three months in prison, one year of supervised release, and a $50,000 fine which included a $100 special assessment.
